Newsflash – USCIS Revises Instructions for Using the DOS Visa Bulletin

On October 14, 2015, the U.S. Citizenship & Immigration Services (USCIS) issued new guidelines for using the Department of State’s (DOS) monthly Visa Bulletin to determine visa availability and filing dates for adjustment of status applications.  Beginning with the November 2015 DOS Visa Bulletin, if USCIS determines that there are more immigrant visas available for a fiscal year than there are known applicants, it will state on www.uscis.gov/visabulletininfo that applicants may use the “Dates for Filing Visa Applications” chart reflected on the DOS Visa Bulletin.  Unless otherwise stated by USCIS, applicants should continue to use the “Application Final Action Date” chart of the DOS Visa Bulletin to determine when they may submit their adjustment of status applications.

USCIS will make and post this determination each month within one week of DOS’ publication of the Visa Bulletin.

If you believe your priority date is current according to the DOS Visa Bulletin and USCIS’ monthly visa availability determination, please contact our office.  For more information about this new procedure, please see the related alert here.
