Newsflash – USCIS I-485 Filing Chart – Filing Dates Affected by Visa Retrogression


As previously announced, according to the Department of State’s August Visa Bulletin, priority date cut-offs will be backlogged in previously unaffected employment-based immigrant visa categories next month.  Specifically, EB-1 India and China final action dates will retrogress to January 1, 2010. EB-2 Worldwide final action dates will retrogress to February 1, 2014.  USCIS has advised that these backlogged ‘final action’ dates also govern when applicants may file I-485 adjustment of status (“AOS”) applications, despite the bulletin showing ‘filing dates’ as current.  It is anticipated that these visa categories and filing dates may become current again once the new fiscal year begins on October 1, 2016.
