Newsflash – USCIS Temporarily Suspends Adjudication of Employment-Based Adjustment Applications through September 30, 2015
On Thursday, September 24, 2015, USCIS announced that it will temporarily suspend the final adjudication of all pending employment-based Form I-485 applications to adjust status to permanent residence. Adjudication will resume on October 1, 2015, with the beginning of the new fiscal year (FY) 2016. The seven-day suspension comes after a Department of State report that the statutory cap has been reached for the employment-based preference categories for FY 2015.
Delays in processing resulting from the suspension are expected to be minimal, given the short window between the announcement and the beginning of FY 2016 next Thursday, October 1, 2015. USCIS will continue to accept submitted adjustment of status applications with current priority dates in the meantime.
