Secretary of Homeland Security Janet Napolitano Issues Statement on Supreme Court Ruling on the Defense of Marriage Act (DOMA)

On June 26, 2013, Secretary of Homeland Security Janet Napolitano issued a statement applauding the Supreme Court’s decision to strike down DOMA as unconstitutional, announcing that “[We will work with our federal partners, including the Department of Justice, to] implement today’s decision so that all married couples will be treated equally and fairly in the administration of our immigration laws.”  This means that married gay couples are now eligible to apply for immigration benefits, including permanent residence sponsorship by U.S. citizen spouses, as well as derivative nonimmigrant visas.
